Well, to be honest, I think the boat was actually ducking well in advanceand just started to point when you were clear. It is rather easy to control the boat in such situations and essentially "chase your stern" if AWA permits so it might look a lot closer than it actually was from the other skipper's PoV.
In such situations one should always make brief sanity check that why the other boat really wanted to go right instead of continuing to left/making a tack
Typically when boat ducks, the boat wants to sail on that specific tack and the small penalty for losing height is compensated by the choise of side (or, covering some other boat etc.) so eventually you are in a situation where you should consider, which one knows better. Would the ducking boat be Charlotta, I'd be tacking immediately when it was evident that the boat continued to the right

Well in this case the wind shifted so that on port tack you were hitting against the big waves and on starbord sailing along the waves. Also we found out that left side and top of the track was more favourable due to smaller size of waves. So it was easy to continue our strategy to sail left and aboach top wind mark on port tack, witch we rounded just ahead of that crossing bigger boat.
